This disclaimer applies to Zahavi Digital Clarity diagnostics, written reports, optional short final walkthroughs, recommendations, action plans, case studies, website content, emails and related materials.
It should be read together with the Terms of Service, Privacy Policy, Refund & Cancellation Policy, Confidentiality & Data Handling page, Cookie & Analytics Notice and the written scope agreed for the specific project.
The written diagnostic is intended to support clearer decision-making and prioritisation.
It is not a promise of a particular financial, marketing, SEO, technical, legal or operational result.
1. Purpose of the diagnostic
Zahavi Digital Clarity helps service businesses understand where their website, lead journey and customer journey may become unclear or lose effectiveness.
The written diagnostic may help answer questions such as:
- What appears to be happening?
- Where may enquiries or opportunities be lost?
- Which findings are supported by available evidence?
- Which important actions are not currently measured?
- Which possible causes require further testing?
- What should be addressed first?
- What can reasonably wait?
- Where may additional spending be premature?
The service provides written analysis, explanation, prioritisation and decision support.
It does not guarantee that the client's business will improve or achieve a specific result.
2. Scope of the diagnostic
Depending on the selected package, agreed scope, available evidence and business situation, the diagnostic may review:
- website clarity, usability and trust;
- technical website health visible within the agreed scope;
- functional QA of important pages, forms, buttons and paths;
- SEO, indexing, crawlability and organic visibility;
- traffic sources and audience quality;
- analytics and conversion tracking;
- forms, WhatsApp, phone, email, booking or checkout paths;
- lead handling and response processes;
- follow-up gaps;
- customer journey continuity;
- available customer-value or repeat-business information;
- visible privacy, accessibility, security or trust concerns that may require specialist review.
Not every project includes every diagnostic area.
The confirmed written scope determines:
- what will be reviewed;
- what information or access is required;
- what deliverables are included;
- which limitations apply;
- which areas remain outside the project.
3. Point-in-time assessment
Unless ongoing monitoring is separately agreed in writing, the diagnostic is a point-in-time assessment.
Findings reflect conditions, evidence, systems, access and information available during the diagnostic period.
After delivery, the situation may change because of:
- website edits;
- new campaigns or traffic sources;
- changes in analytics configuration;
- platform, plugin or algorithm updates;
- changes in prices, offers or business processes;
- actions taken by the client or third parties;
- new technical problems;
- changes in law, policy or market conditions.
Zahavi Digital Clarity is not automatically required to update, re-check or monitor findings after delivery unless a separate follow-up scope is agreed in writing.
4. Facts, observations, possible causes and hypotheses
Diagnostic findings may include different levels of certainty.
A report may distinguish between:
- verified information supported by available data, direct testing or observable evidence;
- professional observations based on what can reasonably be seen within the agreed scope;
- possible causes that may explain a finding but are not conclusively proven;
- hypotheses that require additional measurement, testing, access or specialist investigation.
A possible cause or hypothesis should not be treated as a proven fact unless supporting evidence establishes it.
5. Good faith and reasonable professional care
Zahavi Digital Clarity aims to perform diagnostic work in good faith and with reasonable professional care within the agreed scope.
Findings may be based on:
- information available during the review;
- the client's stated business context;
- the selected package and written scope;
- available data and access;
- manual review and functional testing;
- professional tools and reports;
- professional interpretation and prioritisation.
Reasonable professional care does not mean that every hidden issue, future outcome, business risk, technical weakness or external change can be discovered or predicted.
6. Findings depend on available information
Diagnostic findings may be limited where:
- data is missing, incomplete, inaccurate or outdated;
- analytics are absent or incorrectly configured;
- important customer actions are not tracked;
- WhatsApp, phone, email or offline enquiries are not measured;
- traffic includes bots, spam or irrelevant visits;
- advertising or analytics reports contain distorted information;
- required access is unavailable, restricted or does not work;
- third-party platforms provide incomplete or inconsistent data;
- manual processes are undocumented;
- important business facts are unavailable or unknown.
Where reliable quantitative data is unavailable, the diagnostic may rely more heavily on:
- visible customer journey observations;
- functional testing;
- usability and clarity review;
- business information supplied by the client;
- measurement and tracking gaps.
The absence of reliable measurement may itself be an important diagnostic finding.
Findings may change if new, more accurate or materially different information becomes available later.
7. No promise to identify every issue
Websites, analytics, marketing systems, customer journeys and internal business processes can be complex.
The diagnostic may identify significant visible gaps, friction points, risks and priorities, but cannot guarantee that every issue will be discovered.
Some issues may be:
- hidden or intermittent;
- dependent on a specific user, device or location;
- visible only under particular technical conditions;
- caused by a third-party platform;
- visible only with deeper or different access;
- visible only after longer monitoring;
- outside the selected package or agreed scope;
- within a specialist field requiring separate review.
Zahavi Digital Clarity is not required to investigate areas outside the confirmed scope unless a revised scope is separately agreed.
8. No guaranteed results
Zahavi Digital Clarity does not guarantee any specific business, financial, marketing, SEO, advertising, technical or operational outcome.
No guarantee is made regarding:
- more leads or customers;
- better lead quality;
- higher sales, revenue or profit;
- specific SEO rankings or indexing;
- traffic growth;
- advertising performance;
- lower acquisition costs;
- higher conversion rates;
- increased customer lifetime value;
- return on investment;
- removal of platform restrictions or penalties;
- successful implementation of recommendations;
- any particular business result.
It does not promise that changing a particular area will automatically produce a specific commercial result.
9. Recommendations are not implementation
Zahavi Digital Clarity may recommend that an area be:
- clarified;
- fixed;
- tested;
- measured;
- redesigned;
- tracked;
- reviewed by a specialist;
- prioritised for later action.
Unless separately agreed in writing, the diagnostic does not include:
- website development or redesign;
- programming or code changes;
- technical implementation;
- bug fixing or maintenance;
- CRM setup or administration;
- business-process automation;
- paid advertising management;
- full ongoing SEO management;
- legal, accessibility or cybersecurity work;
- ongoing consulting or project management.
Additional implementation or specialist work must be separately agreed.
10. Priorities and the 90-Day Action Plan
Depending on the agreed package, the client may receive:
- a prioritised findings list;
- written priority recommendations;
- recommended next actions;
- an optional short final walkthrough where included or separately agreed;
- a 90-Day Action Plan where included in the confirmed scope.
A priority level reflects professional judgement based on the evidence, business context and scope available during the diagnostic.
A priority or action plan is not:
- a guarantee of return;
- a mandatory instruction;
- a replacement for specialist implementation planning;
- a promise that circumstances will remain unchanged;
- an obligation for Zahavi Digital Clarity to manage implementation.
Priorities may need to be adjusted when new evidence, costs, risks or technical limitations become known.
11. Financial impact and estimates
Zahavi Digital Clarity does not guarantee the financial value of a finding or recommendation.
Where reliable business data is available, the diagnostic may discuss possible commercial impact using the information provided.
Where reliable data is not available:
- financial impact may not be calculated;
- an estimate may be presented only as an assumption or range;
- further measurement may be recommended;
- the absence of reliable financial visibility may itself be a finding.
Any estimate, range, scenario or assumption is illustrative and should not be treated as guaranteed revenue, savings, loss or return on investment.
12. The client remains responsible for decisions
The client remains responsible for deciding:
- whether to follow a recommendation;
- when and how to implement it;
- who should perform the work;
- what budget should be used;
- which risks should be accepted;
- which specialists should be engaged;
- how implementation should be supervised.
Zahavi Digital Clarity does not make final business, financial, legal, technical or operational decisions on behalf of the client.
The client should review recommendations in light of the client's own:
- business circumstances;
- budget;
- technical environment;
- legal obligations;
- professional advice;
- risk tolerance.
13. Third-party professionals and implementation
The client may share diagnostic materials with relevant professionals, including:
- developers;
- designers;
- marketers;
- SEO or analytics specialists;
- CRM specialists;
- advertising professionals;
- lawyers or accountants;
- accessibility specialists;
- cybersecurity professionals;
- employees, contractors or internal teams.
Zahavi Digital Clarity is not responsible for how a third party:
- interprets or changes a recommendation;
- rejects or ignores a recommendation;
- implements the work;
- introduces errors or downtime;
- creates a new privacy, legal, security or technical risk;
- causes loss or delay.
Responsibility for implementation remains with the client and the selected implementation professional, unless another written arrangement expressly states otherwise.
14. Third-party platforms and external changes
Website performance, analytics, SEO, advertising, customer communication and lead flow may depend on external platforms.
These may include:
- Google services;
- Meta services;
- WhatsApp;
- WordPress;
- hosting and domain providers;
- CRM platforms;
- analytics services;
- advertising platforms;
- SEO tools;
- plugins and other external systems.
Zahavi Digital Clarity does not control those platforms and is not responsible for their:
- errors or outages;
- algorithm, interface or policy changes;
- account restrictions;
- pricing changes;
- data inaccuracies;
- privacy or security practices;
- access limitations;
- technical failures.
15. No regulated professional advice
Zahavi Digital Clarity may identify an area that appears to require specialist attention.
However, the service is not:
- legal advice or a legal compliance audit;
- financial, tax or accounting advice;
- investment advice;
- medical or psychological advice;
- a cybersecurity audit;
- penetration testing;
- a formal vulnerability assessment;
- a security certification;
- a formal accessibility compliance audit;
- other regulated professional advice.
Where regulated or specialist advice is required, the client should seek review from an appropriately qualified professional.
16. Legal, privacy, security and accessibility observations
During a diagnostic, Zahavi Digital Clarity may observe a possible issue involving:
- missing or unclear customer information;
- privacy or access management;
- website trust or security signals;
- accessibility;
- customer communication;
- possible legal or reputational exposure;
- possible operational or commercial risk.
Such observations are diagnostic flags only.
They do not constitute:
- a formal legal opinion;
- confirmation of legal compliance or non-compliance;
- a cybersecurity conclusion;
- an accessibility certification;
- a final regulatory determination.
That is different from making a final legal, regulatory or technical determination.
17. Case studies, testimonials and previous results
Case studies, testimonials and previous examples describe past situations only.
They do not guarantee that another business will receive the same or a similar result.
Every business may differ in:
- market and competition;
- offer and pricing;
- website condition;
- traffic quality;
- data and tracking quality;
- lead handling and follow-up;
- budget and internal resources;
- implementation decisions;
- timing and external conditions.
A case study should not be interpreted as a promise, prediction or guarantee of future performance.
18. Confidentiality and publication
Diagnostic projects may involve confidential business information, including:
- analytics and traffic information;
- advertising context;
- website weaknesses;
- technical findings;
- customer journey information;
- lead-handling processes;
- commercial or internal business information.
Zahavi Digital Clarity will not publish:
- the client's name;
- the client's logo;
- an identifiable testimonial;
- exact confidential data;
- an identifiable case study;
without the client's prior written permission.
Anonymised or generalised lessons may be used only where they do not reasonably:
- identify the client;
- reveal confidential information;
- disclose unnecessary personal information;
- misrepresent the work or outcome.
19. Use and sharing of diagnostic materials
The written diagnostic report, action plan and related materials are intended to help the client:
- understand the current situation;
- identify priorities;
- make better-informed decisions;
- communicate with relevant implementation professionals.
The client may share the materials with relevant employees, contractors and professional advisers.
The client should use reasonable care when sharing materials containing:
- confidential business information;
- analytics or screenshots;
- lead or customer information;
- access information;
- sensitive operational context.
Zahavi Digital Clarity is not responsible for how another person:
- interprets the material;
- changes or simplifies it;
- removes relevant context;
- ignores part of it;
- implements the recommendations.
20. Limitation of liability
To the maximum extent permitted by applicable law, Zahavi Digital Clarity is responsible for performing the agreed diagnostic work within the confirmed scope.
Zahavi Digital Clarity is not responsible for:
- the client's business decisions;
- the client's action or inaction;
- third-party implementation;
- implementation errors;
- failure to implement recommendations;
- external market changes;
- algorithm or policy changes;
- third-party platform failures;
- incorrect, incomplete or outdated information supplied by others;
- losses caused by actions outside the agreed scope;
- indirect, incidental, special, punitive or consequential loss where legally permitted.
To the maximum extent permitted by applicable law, if liability relating to a specific paid diagnostic service is established, total liability will not exceed the amount actually paid for the specific service giving rise to the claim.
21. Circumstances outside reasonable control
Zahavi Digital Clarity is not responsible for delays, limitations or inability to perform caused by circumstances outside reasonable control.
These may include:
- illness or medical emergency;
- war, security events or civil emergency;
- government action;
- internet or communication failure;
- hosting or infrastructure outages;
- third-party platform failures;
- unavailable data;
- payment-provider issues;
- other unforeseen events outside reasonable control.
Where reasonably possible, the client will be informed of a significant delay affecting the project.

This Diagnostic Disclaimer should be read together with:
- the Terms of Service;
- the Privacy Policy;
- the Refund & Cancellation Policy;
- the Confidentiality & Data Handling page;
- the Cookie & Analytics Notice;
- the agreed written scope for the project.
A project may also be subject to a:
- proposal;
- scope confirmation;
- NDA;
- data-processing agreement;
- other project-specific written agreement.
Where a project-specific written agreement clearly conflicts with this general disclaimer, the more specific written agreement may apply to that conflict, subject to mandatory applicable law.
23. Governing law and disputes
This Diagnostic Disclaimer is governed by the laws of the State of Israel, unless mandatory applicable law requires otherwise.
The parties are encouraged to first attempt to resolve a disagreement in good faith through direct communication.
If a dispute cannot be resolved amicably, it may be submitted to the competent courts of the State of Israel, unless mandatory applicable law provides otherwise.
24. Language and translations
This Diagnostic Disclaimer may be available in English, Russian and Hebrew for convenience and accessibility.
If different language versions conflict, the English version will generally apply, unless:
- a project-specific written agreement states otherwise;

Zahavi Digital Clarity may update this disclaimer to reflect changes in:
- services or diagnostic scope;
- business processes;
- technology;

- legal or regulatory requirements.
The date at the top of the page identifies the current version.
An updated website disclaimer does not automatically change an existing project-specific agreement or remove rights that arose under an earlier agreement.
