Please read these Terms before approving a diagnostic scope, making a payment or using a Zahavi Digital Clarity service.
Submitting an initial request does not, by itself, require you to purchase a service and does not require Zahavi Digital Clarity to accept the project.
A service engagement normally begins only after the proposed package or written scope has been accepted and payment has been received, unless another arrangement is confirmed in writing.
These Terms should be read together with the Privacy Policy, Refund & Cancellation Policy, Diagnostic Disclaimer, Confidentiality & Data Handling page, Cookie & Analytics Notice and the written scope agreed for the specific project.

2. Nature of the service
Zahavi Digital Clarity provides website, lead and customer journey diagnostic services.
The purpose of the service is to help a client understand:
- where the digital journey becomes unclear;
- where enquiries or opportunities may be lost;
- which weaknesses appear most important;
- which findings are supported by available evidence;
- which areas require further measurement or specialist review;
- what should be addressed first.
The service focuses on diagnosis, explanation, prioritisation and decision support.
It is not primarily a website-development, CRM-configuration, automation or technical implementation service.
3. Possible diagnostic areas
Depending on the selected package, agreed scope, business situation and available evidence, the diagnostic may review areas such as:
- website clarity, usability and trust;
- technical website health visible within the agreed scope;
- functional QA of important pages, forms, buttons and paths;
- SEO, indexing, crawlability and organic visibility;
- traffic sources and audience quality;
- analytics and conversion tracking;
- forms, WhatsApp, phone, email, booking or checkout paths;
- lead handling and response processes;
- follow-up gaps;
- customer journey continuity;
- available customer-value or repeat-business information;
- visible privacy, accessibility, security or trust concerns that may require specialist review.
Not every project includes every area. The exact diagnostic scope is confirmed before paid work begins.
4. Packages, scope and deliverables
Zahavi Digital Clarity may offer Express, Standard and Full packages, or another individually agreed scope.
In general:
- Express is intended for one focused area of uncertainty.
- Standard is intended for a broader review of the main website, lead and customer journey.
- Full is intended for a more complete review and includes a prioritised 90-Day Action Plan where stated in the agreed scope.
Deliverables may include:
- a written diagnostic report;
- written findings and priority recommendations;
- a prioritised list of findings and next actions;
- an optional short final walkthrough where included or separately agreed;
- a 90-Day Action Plan where included in the package;
- notes that may be shared with relevant implementation professionals.
The written scope may define:
- the package;
- the diagnostic areas;
- the information and access required;
- the expected timeline;
- the deliverables;
- the optional short walkthrough length or format, where included;
- the price;
- any project-specific limitations.
A project-specific written scope takes priority over a general website description where the two differ, subject to mandatory applicable law.
5. Formation of the service agreement
An initial diagnostic request is an invitation to review whether the service appears suitable.
Submitting a request does not guarantee:
- acceptance of the project;
- availability;
- a specific package;
- a specific price;
- a specific completion date.
A service agreement is normally formed when:
- the scope or package has been confirmed in writing;
- the client accepts that scope;
- payment is received, unless another payment arrangement is confirmed in writing.
Zahavi Digital Clarity may decline a request where the service is not a suitable fit or cannot reasonably be provided.
6. No guaranteed business result
Zahavi Digital Clarity provides diagnostic analysis, findings, explanations and priorities.
It does not sell or guarantee a specific business, financial, marketing, technical or operational result.
No guarantee is made regarding:
- the number of leads or customers;
- sales, revenue or profit;
- SEO rankings or indexing;
- traffic growth;
- advertising performance;
- cost per lead or acquisition cost;
- conversion rates;
- customer lifetime value;
- return on investment;
- removal of platform restrictions or penalties;
- discovery of every possible issue;
- correction of every problem;
- results produced by later implementation.
Outcomes may depend on factors outside the diagnostic, including the market, offer, pricing, competition, website condition, traffic quality, data quality, team performance, budget, timing, implementation decisions and third-party platforms.
7. What is not included
Unless separately agreed in writing, the service does not include:
- website development or redesign;
- programming or code changes;
- technical implementation;
- bug fixing;
- website maintenance;
- CRM setup or administration;
- business-process automation;
- paid advertising setup or management;
- full ongoing SEO management;
- ongoing project management;
- ongoing consulting or support;
- cybersecurity auditing or penetration testing;
- formal accessibility compliance auditing;
- legal compliance auditing;
- legal, financial, accounting, tax or other regulated advice;
- a guarantee of results after implementation.
Such a finding is a diagnostic observation only. It is not a substitute for advice from an appropriately qualified professional.
8. Available data and diagnostic limitations
The diagnostic is based on the information, access, systems, evidence and business context available at the time of review.
Findings may be limited where:
- analytics are missing or incorrectly configured;
- important customer actions are not tracked;
- data is incomplete, inaccurate, distorted or outdated;
- WhatsApp, calls, email or offline enquiries are not measured;
- traffic includes bots, spam or irrelevant visits;
- required information is unavailable or withheld;
- access is unavailable, restricted or does not work;
- third-party platforms provide inconsistent information;
- manual business processes are not documented;
- hidden technical issues cannot reasonably be observed within the agreed scope.
Where reliable data is available, findings may be supported by relevant metrics.
Where reliable data is not available, the diagnostic may focus on:
- the visible customer journey;
- functional and usability observations;
- measurement gaps;
- what should be tracked or clarified next.
A lack of reliable measurement may itself be an important diagnostic finding.
9. Client responsibilities
The client is responsible for providing information that is accurate, complete and reasonably current.
The client is responsible for:
- providing the correct website and business information;
- describing the relevant business context honestly;
- providing agreed information and access on time;
- having the right to share any information or access provided;
- reviewing recommendations before implementation;
- selecting qualified third parties where specialist work is required;
- supervising implementation;
- making final business decisions;
- the results of those decisions and implementation.
If required information, responses or access are delayed or unavailable, Zahavi Digital Clarity may:
- adjust the timeline;
- limit the analysis;
- pause the project;
- recommend a revised scope;
- end the project where completion is no longer reasonable.
10. Access, credentials and security
No passwords, payment details, billing credentials or administrator access are required when submitting the initial request.
If access is required later, it will be discussed separately.
Read-only, limited-role or temporary access is preferred whenever technically available and reasonably practical.
Zahavi Digital Clarity does not require unrestricted access to:
- websites;
- hosting;
- payment systems;
- CRM platforms;
- advertising accounts;
- analytics platforms;
- other business systems by default.
The client should not send sensitive credentials through unsecured communication channels.
Zahavi Digital Clarity may refuse an unsafe access method and request a safer arrangement.
The client is encouraged to review permissions and revoke temporary access after the diagnostic is complete.
11. Timeline
The usual target timeline for preparing the diagnostic deliverable is up to 3 business days after all required starting conditions are met.
Starting conditions may include:
- the scope has been confirmed;
- payment has been received;
- required information has been provided;
- required access, if any, has been provided and works;
- there are no significant external limitations preventing the review.
Business days generally follow the Israeli working week, Sunday through Thursday, excluding Israeli public holidays, emergencies and notified periods of unavailability.
The timeline may be adjusted where:
- the client delays information or access;
- the project is more complex than initially understood;
- available data is insufficient;
- third-party systems cause delays;
- circumstances outside reasonable control affect the work.
12. Payment
No payment is required merely to submit an initial diagnostic request.
Payment is normally requested only after the request has been reviewed and the package or written scope has been confirmed.
Paid diagnostic work normally begins only after:
- scope confirmation;
- payment;
- receipt of required information;
- receipt of required access, where applicable.
The client pays for:
- individual diagnostic work;
- professional review and analysis;
- interpretation and prioritisation;
- preparation of the agreed deliverables;
- an optional short final walkthrough where included or separately agreed;
- the 90-Day Action Plan where included.
Payment is not for a guaranteed business result.
13. Cancellation and refunds
Cancellation and refund conditions are explained in more detail in the Refund & Cancellation Policy and any project-specific written scope.
If the client cancels before paid diagnostic work begins, a refund may be available subject to:
- the agreed terms;
- payment-provider conditions;
- any work already authorised or performed;
- mandatory rights under applicable law.
Once individual diagnostic work has started, any refund may be reduced to reflect work already performed, preparation, professional review, reserved time and reasonable costs, where legally permitted.
Failure by the client to provide agreed information, responses or access does not automatically create a right to a full refund after work has started.
Where mandatory consumer-cancellation rights apply, those rights take priority over any conflicting part of these Terms.
14. Optional short walkthrough and action plan
The main deliverable is written diagnostic work. Where included in the agreed package or separately agreed, an optional short final walkthrough is intended to:
- explain the most important written findings;
- separate urgent issues from lower-priority noise;
- connect written priorities to practical decisions;
- clarify recommended next actions.
The optional short final walkthrough is not required before starting the diagnostic.
The optional short final walkthrough is not:
- unlimited consulting;
- technical support;
- implementation;
- employee training;
- ongoing project management;
- unlimited access after delivery.
Where a 90-Day Action Plan is included, it is a prioritisation tool divided into practical stages.
It is not a guarantee that a specific action will produce a specific commercial result.
15. Implementation and third parties
The client may share the delivered report with relevant professionals, including a:
- developer;
- designer;
- marketer;
- SEO specialist;
- analytics specialist;
- CRM specialist;
- accessibility specialist;
- cybersecurity professional;
- lawyer;
- accountant;
- internal team member or contractor.
Zahavi Digital Clarity is not responsible for how a third party:
- interprets the report;
- changes a recommendation;
- rejects a recommendation;
- implements a recommendation;
- causes errors, downtime, loss or other consequences.
Unless separately agreed in writing, implementation is outside the diagnostic scope.
16. Confidentiality
A diagnostic may involve non-public business information, including:
- analytics and traffic information;
- advertising context;
- website weaknesses;
- technical observations;
- customer journey information;
- lead-handling or follow-up processes;
- commercial information;
- internal documents;
- other information provided for the agreed service.
Zahavi Digital Clarity will use reasonable care when handling confidential business information and will not intentionally disclose it except where disclosure is:
- authorised by the client;
- reasonably required to provide the agreed service;
- required by law or lawful authority;
- reasonably necessary to protect legal rights or prevent serious harm.
Confidentiality generally does not apply to information that:
- is already public through no breach by Zahavi Digital Clarity;
- was lawfully known before disclosure;
- was independently developed without using the client's confidential information;
- was lawfully obtained from another source without confidentiality restrictions;
- must legally be disclosed.
The general confidentiality approach is described further in the Confidentiality & Data Handling page.
That page is not, by itself, a separately signed NDA or Data Processing Agreement.
Where a formal NDA, DPA or vendor security agreement is required, it should be discussed and agreed before restricted information is shared.
17. Personal information and privacy
The website and diagnostic process may involve personal information such as:
- name;
- email address;
- phone or WhatsApp number;
- business name;
- website address;
- information included in a request;
- other information voluntarily provided.
Personal-information handling is described in more detail in the Privacy Policy and Confidentiality & Data Handling page.
Clients should avoid providing:
- unnecessary third-party personal information;
- full customer or lead databases;
- medical information;
- children's information;
- government identification numbers;
- bank or payment-card information;
- private conversations unrelated to the diagnostic;
- information not required for the agreed scope.
Where a client provides information about customers, employees, leads or other people, the client confirms that they have an appropriate right or legal basis to provide it for the agreed purpose.
18. Professional tools and service providers
Zahavi Digital Clarity may use professional software, analytics platforms, website-testing tools, SEO tools, browser tools, QA methods, communication services, document tools and other third-party services to support the diagnostic workflow.
Tool output may be:
- incomplete;
- incorrect;
- outdated;
- affected by third-party limitations;
- in need of professional interpretation.
Findings are therefore based on available evidence, business context, interpretation and professional prioritisation.
Third-party providers may process information according to their own terms, privacy policies, infrastructure and security practices.
19. Case studies, examples and testimonials
Zahavi Digital Clarity will not publish the client's name, logo, identifiable testimonial, exact confidential data or an identifiable case study without the client's prior written permission.
Anonymised or generalised lessons may be used only where they do not reasonably:
- identify the client;
- reveal confidential information;
- disclose unnecessary commercial details;
- misrepresent the work or result.
Anonymisation may include:
- removing the business name;
- describing only the general industry;
- removing exact figures;
- generalising technical details;
- removing identifying circumstances.
A published example or case study does not guarantee that another client will receive the same result.
20. Intellectual property and permitted use
The client retains ownership of the client's own pre-existing:
- business information;
- website content;
- data;
- documents;
- branding;
- other materials supplied for the project.
Unless otherwise agreed in writing, Zahavi Digital Clarity retains ownership of its pre-existing and original:
- diagnostic methodology;
- frameworks;
- templates;
- report structures;
- checklists;
- original wording;
- internal working methods.
The client receives a non-exclusive right to use the delivered report for internal business decision-making and to share it with relevant professionals for review or implementation.
Without written permission, the client may not:
- resell the report as their own diagnostic service;
- present Zahavi Digital Clarity methodology as their own;
- commercially redistribute templates or frameworks;
- copy substantial original material for unrelated resale.
21. Limitation of liability
To the maximum extent permitted by applicable law, Zahavi Digital Clarity is responsible for performing the agreed diagnostic work within the confirmed scope.
Zahavi Digital Clarity is not responsible for:
- the client's business decisions;
- the client's action or inaction;
- implementation by the client or third parties;
- implementation errors;
- failure to implement recommendations;
- results following implementation;
- incorrect, incomplete or outdated client information;
- third-party platform errors or outages;
- algorithm, policy or interface changes;
- account restrictions imposed by third parties;
- losses caused by systems outside reasonable control;
- indirect, incidental, special, punitive or consequential loss where such limitation is legally permitted.
To the maximum extent permitted by applicable law, if liability relating to a specific paid diagnostic service is established, total liability will not exceed the amount actually paid for the specific service giving rise to the claim.
22. Communication and scope control
Communication may take place through:
- email;
- WhatsApp;
- website forms;
- video calls;
- another agreed channel.
Zahavi Digital Clarity does not guarantee an immediate response.
Both parties are expected to communicate respectfully, clearly and professionally.
Zahavi Digital Clarity may refuse, pause or end work where:
- the service is not a suitable fit;
- the client demands guaranteed outcomes;
- the client repeatedly requests work outside the agreed scope;
- required information or access is not provided;
- the client requests illegal, deceptive, unethical or unsafe conduct;
- the client behaves abusively or threateningly;
- a material conflict of interest arises;
- the diagnostic cannot reasonably be completed;
- continuing would create unreasonable legal, security or professional risk.
If work has already started, any refund question will be reviewed according to:
- the work already performed;
- the agreed scope;
- reserved time;
- the Refund & Cancellation Policy;
- mandatory applicable law.
23. Third-party platforms
A diagnostic may review or rely on information from third-party systems such as:
- Google services;
- Meta services;
- WhatsApp;
- WordPress;
- hosting providers;
- analytics platforms;
- advertising platforms;
- CRM systems;
- SEO tools;
- plugins;
- other external services.
Zahavi Digital Clarity does not control these third-party platforms and is not responsible for their:
- errors or outages;
- data loss;
- incorrect reports;
- interface or policy changes;
- algorithm changes;
- pricing changes;
- account restrictions;
- privacy or security practices;
- access limitations;
- technical failures.
24. No regulated professional advice
Zahavi Digital Clarity may identify an area that appears to require specialist attention.
However, the service is not:
- legal advice;
- financial advice;
- tax advice;
- accounting advice;
- medical or psychological advice;
- investment advice;
- a cybersecurity audit;
- penetration testing;
- a formal accessibility compliance audit;
- other regulated professional advice.
Where specialist or regulated advice is required, the client should consult an appropriately qualified professional.
25. Force majeure and circumstances outside reasonable control
Zahavi Digital Clarity is not responsible for delays or inability to perform caused by circumstances outside reasonable control, including:
- illness or medical emergency;
- war, security events or civil emergency;
- government action;
- internet or communication failure;
- hosting or infrastructure outages;
- third-party platform failures;
- unavailable data;
- natural disasters;
- other unforeseen events outside reasonable control.
Where reasonably possible, the client will be informed of a significant delay affecting the project.
26. Governing law and disputes
These Terms are governed by the laws of the State of Israel, unless mandatory applicable law requires otherwise.
The parties are encouraged to first attempt to resolve a disagreement in good faith through direct communication.
If a dispute cannot be resolved amicably, it may be submitted to the competent courts of the State of Israel, unless mandatory applicable law provides otherwise.
27. Changes to these Terms
Zahavi Digital Clarity may update these Terms to reflect changes in:
- services;
- business processes;
- technology;
- website functionality;
- legal or regulatory requirements.
The date at the top of the page shows when the current version was last updated.
An updated website version does not automatically change an already agreed project-specific scope or remove rights that arose under an earlier agreement.
28. Entire agreement, severability and no waiver
These Terms, the written project scope and the applicable website policies form the general agreement relating to the diagnostic service.
Where a specific written project agreement clearly conflicts with these general Terms, the more specific written agreement may apply to that conflict, subject to mandatory applicable law.
If any provision is found invalid or unenforceable, the remaining provisions will continue to apply to the maximum extent permitted by law.
Failure to immediately enforce a right does not automatically waive that right.
29. Language and translations
These Terms may be available in English, Russian and Hebrew for accessibility and convenience.
If different language versions conflict, the English version will generally apply, unless:
- a project-specific written agreement states otherwise;
- mandatory applicable law requires another result.
Clients should read the version they understand best before accepting a scope or making payment.
